Case name formatting notes



Typeface for case names
For Bluebook style citations, case names are presented differently depending on the type of document being prepared and the placement of the citation within the document. For court documents and legal memoranda, and citations placed within the body of the document, case names should be underscored or italicized. In law review footnotes, case names should be presented in either roman type, or Small Caps, depending upon the editorial preferences listed in the particular law journal's Instructions to Authors.

For ALWD citation style, case names are presented in italics for all documents, whether the citations are placed in the body of the document or in footnotes.

For articles submitted to law journals and reviews, always consult the Instructions to Authors for information on which citation style to use.

If you are using LegalCitation software, enter the case name using the rules for deriving the proper case name for the citation using the rules below, but without any print attributes. LegalCitation will add the appropriate print attributes for the style selected when the citation is formatted.

Case name for consolidated actions
If the caption lists two or more cases, cite only the case first listed.

Examples:

Two names for one case
If one case has two different names, use the initial one listed in the caption.

Parties to include in the case name
  • Cite only the first-listed party on each side of the case. Also include the first-listed relator, if any. Consult [link] for information on relators.
  • Do not use "et al.," "et ux.," or other terms to denote omitted parties.
  • If a party has been otherwise named, do not include any party's designation, such as plaintiff, defendant, apellant, appellee, petitioner, respondent, intervenor, adminstrator, executor, licensee, or trustee.
  • Place a "v." between the parties names if that is done in the caption.

Individual as party
Use the individual's complete surname (last name).

Organization as party
  • Include the organization's full name, but omit abbreviations such as "d/b/a" ("doing business as") and words that follow such abbreviations.

  • If the organization name includes the name of an individual, include the full name, not just the surname.

  • Consult your style guide to abbreviate words in the party's name.

  • When there is no danger of confusion, commonly known initials may be substituted for a party's complete name (ACLU).

  • When a name includes two business designations, you may delete the second business designation. Business designations are Assn., Co., Corp., F.S.B., Inc., Ltd., N.A., R.R., and Ry.

Union as party
Include only the local unit as party to the case. If the local unit is not appropriate, treat the union as an organizational party.

Include as "U.S." rather than "United States" or "United States of America."
